CBD Oil in Missouri: A review of the laws and availability of CBD in the state.

Like in all other jurisdictions, Missouri had banned the use of marijuana in any form until recently. Marijuana laws in this state changed significantly in 2018. This is the year when the people approved Amendment 2 through a ballot measure on 6th November. This amendment allowed the use of medical marijuana for people who were licensed by the Department of Health and Senior Services (DHSS). For you to receive this license, you must have a recommendation from a recognized doctor. The conditions that can be managed using CBD are listed in the legislation.

This was a significant expansion to the legislation regulating the usage of marijuana up to then. By previous legislation, medical marijuana was only legal for people with intractable strains of epilepsy, such as Dravet Syndrome and Lennox-Gastout Syndrome. Even then, the law only allowed the use of CBD dominant marijuana with a maximum of 0.3% THC. This was informed by research findings and by the approval of Epidiolex. Epidiolex is a CBD based drug used for the management of these types of marijuana by the FDA.

Thus the law allows the use of CBD dominant products only for people who have been authorized by the government. It doesn’t expressly permit the use of CBD, but law enforcement hasn’t prioritized its prohibition. As a result, CBD in the state exists in a sort of a legal grey area.

Voluntary use of CBD in Missouri exists in a legal grey area, as observed above. The only way to obtain legal CBD is with a medical marijuana card from the Department of Health and Social Services at the recommendation of a recognized physician. This makes it relatively hard for people who seek to use CBD for general wellness to access products.

Although the law doesn’t allow the use of CBD, the government doesn’t prioritize enforcement of the prohibition. This has given some latitude to certain natural food and vape products establishments to sell CBD alongside their other products. It is also possible to buy CBD products from online sellers as some of them are open to sell and ship their products to the state.

The law allows people with medical marijuana cards to grow up to six hemp plants for their use. They can then process their own CBD oil from these hemp plants.
